Terms of Use (End User License Agreement)

Please read these Terms of Use ("Terms") carefully before using the Driving Test Go mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Driving Test Go, you confirm that you:

• Are at least 17 years old (the minimum age for a provisional UK driving license)
• Accept and agree to comply with these Terms
• Have the authority to enter into this agreement

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Access and use the App for personal, non-commercial purposes

This license does not allow you to:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Rent, lease, or sublicense the App
• Use the App for commercial purposes without our written consent

3. Subscription Terms

3.1 Auto-Renewable Subscription

Driving Test Go offers an auto-renewable monthly subscription ("Pro Access") with the following terms:

• Title: Pro Access Subscription
• Duration: 1 month (auto-renewing)
• Price: Displayed in the App at time of purchase (varies by region)
• Access: Unlocks all routes for up to 2 test centres of your choice
• Renewal: Automatically renews each month unless cancelled at least 24 hours before the end of the current period

3.2 Payment and Billing

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• The renewal cost will be clearly displayed in your account settings
• Subscriptions may be managed and auto-renewal may be turned off in your device's Account Settings

3.3 Cancellation and Refunds

• You may cancel your subscription at any time through your App Store or Google Play account
• Cancellation takes effect at the end of the current billing period
• No partial refunds for unused portions of a subscription period
• Refund requests are subject to Apple's or Google's refund policies
• Access to premium features continues until the end of your current billing period after cancellation

4. Content and Accuracy

Practice Purpose Only: The routes and information provided in this App are for practice and educational purposes. While we strive for accuracy:

• Route data is based on publicly available information and may not reflect current driving test routes
• Routes may change without notice
• We do not guarantee that these routes will appear in your actual driving test
• This App is not affiliated with, endorsed by, or connected to the DVSA (Driver and Vehicle Standards Agency) or any official UK government body
• Always follow current road signs, traffic laws, and your instructor's guidance

5. User Conduct

You agree NOT to:

• Use the App while driving or operating a vehicle
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use automated tools (bots, scrapers) to access the App
• Reproduce, redistribute, or resell App content without permission

6. User-Generated Content

You retain ownership of notes and progress data you create in the App. By using the App, you grant us a license to store this data locally on your device and, where necessary, sync it for backup purposes. We will not share your personal notes with third parties.

7. Intellectual Property

All content, features, and functionality of the App, including but not limited to text, graphics, logos, and software, are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8. Location Services

The App may request access to your device's location to show nearby test centers. Location access is optional, and you can change permissions in your device settings at any time. Location data is processed locally and is not transmitted to our servers.

9. Disclaimers and Limitation of Liability

9.1 "As Is" Basis

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or other harmful code
• Any errors or omissions in content
• Outcomes of your driving test (passing or failing)

10. Indemnification

You agree to indemnify and hold harmless Driving Test Go, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Third-Party Services

The App may integrate with third-party services such as:

• Apple Maps and Google Maps for navigation
• Apple App Store and Google Play Store for payments
• Cloudflare for infrastructure

Your use of these services is subject to their respective terms and privacy policies.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App or on our website. Your continued use of the App after changes constitutes acceptance of the revised Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including but not limited to breach of these Terms. Upon termination:

• Your license to use the App will immediately cease
• You must delete the App from all devices
• Subscription fees are non-refundable except as required by law

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Driving Test Go regarding the use of the App and supersede any prior agreements.
